Mozambiquephoto ("MZP")

On-Line Image Library Photographic Images ("Images") — Terms Of Use

MZP is willing to license the use of the Images to you only if you accept all of the following Conditions of Use. Please read these Terms of Use carefully because downloading and/or using the Images will be deemed to be your acceptance that you are using the Images on the following terms.

The Images on this on-line image library are protected under copyright and other laws of Mozambique, international conventions and similar laws abroad. Copyright and other intellectual property rights in the Images, is owned or controlled by MZP or its licensors.

You and only you are authorised to use the Images on a royalty free, non-exclusive and non-transferable basis subject to the following conditions:

1. You may only use the Images for the project or promotion referred to in the Project Request form submitted by you.
2. If you wish to use any Image for another project you are required to submit a new Project Request form.
3. Unless this licence is earlier terminated by MZP your right to reproduce the Image will expire on the date notified by MZP to you when MZP confirms its acceptance of your Project Request.
4. The Images may only be used for the purpose of promoting Mozambique as a visitor destination.
5. The Images must not be used for paid advertising unless you are one of the Key Partners of MZP (being a person that MZP has confirmed as having that status).

You warrant that you shall not at any time take any step or make any omission that brings the reputation or good standing of the author of the Image, MZP or Mozambique ito disrepute. In addition, you must acknowledge the author of an Image in any use of that Image.

You will defend and indemnify MZP against all costs, expenses and damages incurred in connection with any claim against MZP arising out of or related to: (a) a breach by you of these Terms of Use; (b) the use of the Images either alone or in combination with any other material; or (c) any claim by a third party related to the use of the Images either alone or in combination with any other material.

The Images are provided to you on an "as is" basis. MZP does not give any warranty or other assurance as to the accuracy, completeness or fitness for any particular purpose of the Images appearing in the on-line image library. To the fullest extent permitted by law, MZP disclaims all responsibility for any damages or losses (including, without limitation, financial loss, damages or loss of business, loss of profits or savings, direct and indirect or consequential damages or losses) arising in contract, tort (including, negligence) or otherwise from the use of, or inability to use the Images or from any action or decision taken as a result of using the Images. If MZP becomes liable to you for any form of loss or damage, MZP’s liability to you arising out of all claims for loss or damage under these Terms of Use will not exceed in aggregate Mtn1.00.

If, for any reason whatsoever and at its sole discretion, MZP wishes to terminate this licence, it may do so immediately by giving written notice to you. On receipt of this notice or on the expiry of the licence, you must, as directed by MZP, return all copies of the Images to MZP or destroy all copies of the Images that are in your possession. You must also provide a written undertaking that no further copies of the Images are or will be used or retained by you for any reason.

FUTUR is the trading name for the Mozambique Tourism Board. The name and logo of the Mozambique Tourism Board are registered trade marks. You are not permitted to use or reproduce or allow anyone to use or reproduce these trade marks for any reason without FUTUR’s express written consent.

These Terms of Use will be governed and interpreted in accordance with the laws of Mozambique.
